Ok, we would like to see everyone's stance on a situation that happened here with a customer earlier.

We have a black velvet female who is for sale. At birth, she was beaten up by her fiesty brother who ended up pulling out a chunk of her fur on the top of her head. We then started to rotate, and anyways, all ended well. Both chinchillas were fine- until the week that we weaned them. The brother sold, and the sister we had to keep back because she was fluctuating her weight too much. When the customer decided they wanted her, we told them everything about the girl and they were fine with it. They said, "We will be taking her to the vet when we get her to make sure she's healthy, as long as she's healthy, everything will be fine." We received the $50 non-refundable deposit (it is clearly stated on our web site and in the various emails that we had sent back and forth before they picked her out.) We picked a date and then WE (the breeders) postponed it due to her lack of staying at a constant weight. Why sell a chinchilla that is sick and who can't keep up her weight? At that time, we offered to refund their $50 non-refundable deposit because we knew that it might be some time that she was ready to leave, if at all. So a few weeks later, after watching her carefully, we decided she was ready. We emailed the customers and set up an appointment. That day came and they were supposed to be here at 5:30pm. And at 4:48pm (exactly), they emailed us and told us that they were not to come because of the thunderstorms that they expected us to have. So, we then rescheduled, and the appointment was for today at 5:30pm. Well, 5:30pm came and went. Now it was 7pm. Still no sign. 8pm, no sign, no calls, so we went out. Now the neighbors were out and saw that they were ringing our doorbell for atleast 30 minutes. Left, and then came back at around 9:30pm. Our internet was down from 2pm-9pm, where THEN we read an email that said they no longer want the chinchilla, but they want their [non-refundable] deposit back. I called him while I was not in the area, and he answers.

I started the conversation by saying "Hello, someone just called me from this number?"

and he replies, "Hi Ryan, I'm sitting outside of your residence."

I then said, "Ok, well, we were home until about quarter to eight and we didn't hear from you or anything. Now, we are not in the area so we will have to reschedule."

"This seems to be such a big problem, we do not want to get the chinchilla anymore and we would like our deposit back."

"Sorry, [enter name here], but it is a non-refundable policy and we made you aware of that before you sent the deposit. It also states it on our web site."

SO, the phone conversation took about 30 minutes. He threatened to take us to court over the $50. He threw it in my face that I DID offer to give back the deposit (the first time I POSTPONED the appointment, but like it says on our web site- SEE BOTTOM) I told him that the $50 could go towards another chinchilla in the future (they didn't have time for one now because they were going on vacation - but we got an email confirming them coming two days before!) We don't have time for that court crock. I FINALLY gave in, because I was getting so frustrated, and by this time I wanted to say not so nice things anymore, and I offered to give him back HALF (making it $25).

Now - what would you have done? How would you have handled this? Has this happened to others, and how have you 'fixed' it?

However, if we terminate the sale of any animal, you will receive your deposit back or credit towards another animal. We expect to receive the deposit within five days unless otherwise discussed. We are willing to make special arrangements if necessary, depending upon the case. If we do not receive the deposit within five days, we will put the animal back up for sale. We are also willing to make payment plans to pay off an animal in full before pick-up. The amount of the deposit will be determined by us depending upon the type of animal purchasing. For the deposit, we accept cash, money orders/cashier's checks, personal checks and paypal. We will give you a receipt at pickup, or if wanted upon request.


FORGOT TO ADD- They paid paypal and wanted cash back. Ridiculous!

You already know my stand on this.. I think you guys were overly generous to offer even half the money back.

Sorry you had to deal with a jerk of a customer today.. you guys are always so nice ..its such a shame some people try and take advantage of that.

you just said it all..
its clearly there in your deposit comment.. if YOU terminate the sale, (which you did not) the deposit is refunded..
if THEY terminate the sale, (clearly they did) no deposit refunded.. i'm with chinchewy1, i wouldnt have given em a penny back.. nope.. no way... but i admire you for swallowing the last choice words and giving back half...

It has happened to me, but it was over someone not being patient enough about a chin who was pregnant(I did not want to ship her during her pregnancy.). I don't know if they thought I could wave a magic wand to make the chin deliver her babies quicker or what.

Anywho, as it states on my website also and in my policy that buyers sign upon putting a deposit down, the deposit is only refundable if an accident or injury, occurs here prior to the chin going to their new home(i.e. accidental death due to kits fighting, broken leg- not like it has happened, but still - you never know, etc..). Deposits are not refundable if the buyer backs out at all.

I'd just tell them tough luck. I would not give in to them. If someone TRULY wants a chin, they won't let impatience or time ruin it. I have waited up to 8 months to get just two chins shipped to me. Sure I might have wanted them sooner, but I am not going to complain or change my mind on the chins. When I want a chinchilla, I don't change my mind.
If a person is a truly suitable home and truly wants a certain chinchilla, then they shouldn't be so wishy washy or change their minds like that.

I was threatened with the, "I am going to report you for bad business," btw for choosing to not refund the deposit. Doesn't look like that report must have gone through well, LMAO. :laugh: I know if it went to court, it would be laughed out anywho. It's right in my agreement that the person signed and sent back to me when they put the deposit down. So they signed agreeing to the terms of a non refundable deposit unless an accident occurs to the chinchilla(as stated above).

Serena, good idea. I will make it in writing that they have to sign along with their deposit. And if it's paypal, I'm going to come up with a new form like a "click here to pay for a deposit" and they must click and "sign"/type their name to make sure they understand. Good good. Thanks!

Are we "doing anything illegal?" If we don't file taxes or anything? I mean, as you all know, Chins are not a money making business.. lol. We don't sell to pet stores, only to people who come to us asking.

I would have said they were "sh*t out of luck". They agreed to your terms of sale when they handed you that deposit. If they had a fit, I would have subtracted money for each day that the animal was in your care, after the point that it was deemed ready forsale. I would then subtract money for feed, hay, water and such things... Total everything up, and make sure it hit the orignal deposit amount... Tell them their deposit now went to the upkeep of the animal, because you were not able to sell him while you were waiting for them.

I think it was nice of you to give half of the deposit back. You shouldn't have given anything back. They cancled the sale, and gave up that $50.

Recently, I had someone who sent a deposit for a standard kit. The kit, like yours had a lot of fur loss. He wasn't "cute" anymore, as it was right on his face. I offered them another chinchilla, or their money back.. They opted to take the other chinchilla. Had they wanted their money back-- that was fine, something unexpected came up.. However, had they told me they wanted the other chinchilla, never showed up, and THEN decided they didn't want him, I would have considered them backing out of the sale, thus making the deposit mine.

I agree, if you are serious- they are worth waiting for. I waited awhile for my beige girl I got, I'm still waiting on a male I am adding. It's been several months now, and will be several months until he gets here.. Ah well, such is life. I want him, so will wait until the time is right.. I have 6 animals waiting for me at a ranchers place.. They've been there for several months now, but things came up- and I needed to wait to get them. I want them, so I am willing to wait for them...

Megan, I was ready to curse him out on the phone and hang up. But then, I realized he's sitting on my porch (in the rain) and I didn't need to have the cops over tonight. lol.

I would have told them tough luck. Your website clearly states that you keep the deposit, as did your conversations with them, so they could have taken it to court for the rest of their lives and still lost.

I file my taxes and account for everything. For every refund I do, it is accounted for(if I refund.), for every chin I sell or buy, even those in province that have PST on them - it is accounted for in my income tax and when I send in my social service tax return to Revenue Canada each 3 months.
They know I make squat, but it is legally the thing to do since I sell chinchillas.
Honestly I wouldn't have been worried about the cops.
